Just some thoughts…

Personally, I take no issue with people bringing up complicated issues, with no easy answers…not even when it is a serious irritant…such as “children raped in child pornography” has always been.

It’s one of those “Gotcha!” arguments.

What I do take issue with…is a system and culture which demonizes the entirety of everything called “child pornography”, and completely removes said content from public investigation and scrutiny…under threat of severe punishment, for defying the rules.

Personally…I believe the predominant views and attitudes on things like nudity, sex, and exhibitionism verses modesty, are generally dictated and imposed by our culture.

If we lived as a hippy Eden, where everybody was allowed to live clothing optional, and sexually associate out in the open…and children were not barred from these things…where it was all just accepted as normal…then we would not have the same emotions of shame, regret and victimhood, which are predominant in cultures which practice body shame, or shame of sexuality.

I’m not suggesting a hippie Eden is perfect…and there are no perfect environments for all existence of life…

…I am saying, that humans are self defeating when they obsess over human sexuality, what other people are doing…thinking…looking at…

Children being raped in “child pornography” [which I think is a distortion of the term], cannot really be intelligently addressed and dealt with, when we have authoritarians using this as an excuse to round up and incarcerate every person who’s viewed/possessed anything that falls under the umbrella of “child pornography”…which is a wide spanning [and ever growing] category.

One concession…

Some people use the term “child erotica”, to differentiate between children mutually engaged in sexual pleasure, and the filming of children being forced into a sexual situation, or just outright raped…I’m not sure how widely this has caught on, however. I’ve been trying to incorporate it into my own writings and speech…but it’s difficult, after so many years of using the term “child pornography”.

Many of us do not consider adult with child porn, to be “child pornography”…and we certainly reject all porn lacking actual children, to be “child pornography”…In addition, we don’t look upon the filming of children being sexually brutalized, as being “child pornography”…

These are rogue elements which should be flushed out…but to some extent, they flourish due to the fact that “child pornography” has been pushed so deeply underground.

In all fairness…I’m certain this would still remain deeply underground, even if “vanilla style child pornography” were decriminalized…but the point is…there is a wide range of things being grouped in with “child pornography”…and many of us object not only to this bullheaded, forced equivalence grouping…but we also vigorously object to children being subjected to sexual brutality.

As an aside…I personally use the term “sexual brutality”, to differentiate from the socially distorted “sexual violence”…the latter not really caring so much if violence is involved, as it is with tainting a wide range of sexual behaviors, with the concept of violence.

We should keep in mind…children are not innocent, disinterested and uninvolved pawns in all of this.

If the internet has taught us anything…it’s that children and youth, on some level, have a natural capacity towards sexual expression…something that has always been understood by people into child erotica…and the legal statistics are starting to substantiate this in a concrete manner.

What is it?…something like 30 to 40 percent of the arrests and charges in modern times, are of people under eighteen years of age…some are even prepubescent…

…We are talking about the producers and distributors, here…they are kids…not adults…These are kids who decided they wanted to get a sexual thrill via online exhibitionism, and maybe make some money at the same time.

They exist…they are out there…and this inconvenient fact can no longer be hidden…And I have absolutely zero trouble believing this, because I was exactly the sort of boy who would have done this sort of thing, had the technology existed when I was that age…As a social demographic, we sorts of people do exist.

So…to bring this to a close…

Many of us have been demanding for decades an answer…as to why sexual brutality has been forcefully tied to literally all sexual expression involving people under the age of eighteen, like a ball and chain around the neck…

We have also demanded an answer, as to why the authoritarians keep framing this issue…as if those who have tolerance [and fondness] for child erotica, are somehow agreeing with sexual brutality against children…or worse…claiming that “they are the cause of it”…

Between the harmless individuals who simply love watching cute seven year old boys sucking each other off, and the authoritarians who will freak out and behave in gross disproportion to whatever situation is in front of them…it is the power holding authoritarians and their masses, who are far more directly and demonstrably responsible for the ills which befall children and teenagers in the realm of “child pornography”.

I’m not suggesting modern society can wrap it’s mind around this [certainly not where I am from]…but if we want to actually do something of real substance to combat sexual brutality in “child pornography”…then it needs to be decriminalized, brought out into the open and kept functioning under rules and oversight.

This war on human sexuality, has been about as productive as the war on drugs…It’s time to bring this failure to an end, and at least try something different.

“In Russia, possessing child pornography is not a crime and laws that govern child exploitation are weak. Government authorities say the majority of sexual crimes against children are never reported or investigated.

Those are among the reasons that even the Russian government admits the country is a world leader in the production of child pornography.

For the first time people will be held criminally responsible for storing child pornography even if they don’t distribute it. To this day, you can’t punish anyone for that” in Russia, [Elena] Mizulina said. The bill has now passed its second of three readings in Russia’s State Duma, the lower house of the legislature.”

I’ve been saying for years, that there remains various places where having child pornography is still legal…even today.

I have to admit, though…I did not realize Russia was one of them.

I mean…I’ve done enough reading to know, Russian boys are really hot in this arena…and Russian boy sites have been quite numerous…and legendary…

…but I always thought that was an organized crime, sort of thing…like, the Russian mob greasing government palms, to ignore what they were doing…

I didn’t realize you could openly own the content…

In fact, I thought Russia had draconian pornography laws, in general…

…I guess you learn something new, every day.

“FREDERICTON — Police are warning parents after four young New Brunswick children voluntarily shared nude images of themselves online.

RCMP say the children, between the ages of eight and 12, shared nude pictures or videos on unspecified free websites in recent months.

The children were identified by the RCMP’s Internet Child Exploitation Unit, and all have been confirmed to be safe.

“It is unfortunately becoming more common for young people, even children, to share exploitative photos and videos of themselves online, and once it’s online it can’t always be removed,” New Brunswick RCMP Sgt. Chantal Farrah said in a statement Wednesday.”

“Abstract

Recent years have seen a significant increase in the criminal penalties associated with possession of child pornography. The new severity appears to be premised on arguments that blur the distinction between those who possess images of child pornography and those who sexually abuse children. In particular, sentences have been increased based on arguments that possession of pornography is equivalent to or worse than child sex abuse, arguments that viewing child pornography increases the risk that an individual will sexually abuse a child, and arguments that those who possess child pornography are abusing children undetected. This Article identifies instances where possession of child pornography and child sex abuse have been conflated, critically evaluates the arguments that promote such conflation, and identifies independent concerns with conflation. Specifically, it argues that blurring the distinction between the two crimes allows us to continue to misperceive child sex abuse as a stranger-danger issue, and that when law enforcement statistics aggregate possession and child sex abuse, then the public may be misled into believing that law enforcement is successfully battling child sex abuse, when that is not the case. The Article concludes that the modern trend of increasing sentences for possession of child pornography ought to be reviewed, and it suggests several possible areas of reform.”

“Background

There is an ongoing debate on whether consumers of child pornography pose a risk for hands-on sex offenses. Up until now, there have been very few studies which have analyzed the association between the consumption of child pornography and the subsequent perpetration of hands-on sex offenses. The aim of this study was to examine the recidivism rates for hands-on and hands-off sex offenses in a sample of child pornography users using a 6 year follow-up design.

Methods

The current study population consisted of 231 men, who were subsequently charged with consumption of illegal pornographic material after being detected by a special operation against Internet child pornography, conducted by the Swiss police in 2002. Criminal history, as well as recidivism, was assessed using the criminal records from 2008.

Results

4.8% (n = 11) of the study sample had a prior conviction for a sexual and/or violent offense, 1% (n = 2) for a hands-on sex offense, involving child sexual abuse, 3.3% (n = 8) for a hands-off sex offense and one for a nonsexual violent offense. When applying a broad definition of recidivism, which included ongoing investigations, charges and convictions, 3% (n = 7) of the study sample recidivated with a violent and/or sex offense, 3.9% (n = 9) with a hands-off sex offense and 0.8% (n = 2) with a hands-on sex offense.

Conclusion

Consuming child pornography alone is not a risk factor for committing hands-on sex offenses – at least not for those subjects who had never committed a hands-on sex offense. The majority of the investigated consumers had no previous convictions for hands-on sex offenses. For those offenders, the prognosis for hands-on sex offenses, as well as for recidivism with child pornography, is favorable.”

Many people don’t like to hear this…but the superstition of “child pornography causing pedophiles to move on to child molestation”, has never faired all that well when held up to scrutiny.

“How would you feel if you could be sentenced to spend twenty years in prison for owning a nude photograph of your lover and another twenty years for actually having sex with her or him? If your partner is a minor, you could easily receive such a sentence under new kiddy-porn laws and old age-of-consent legislation. It is a federal offense to produce, own, or distribute sexually explicit material if the subject is sixteen or younger. Thirty-five states enacted similar legislation in 1977 and 1978. The penalties for “statutory rape” (sex between a legal adult and a minor) are grim. Convicted pedophiles may do more time for having sex with minors than they would for manslaughter. Once incarcerated, they have a difficult time securing probation or parole, and other prisoners harass, beat, and even kill inmates who are known to be “child molesters.”

The kiddy-porn laws were passed during a flurry of public outrage over violent child abuse and the sexual exploitation of children, but they have done nothing to diminish the brutal treatment of young people. Children and teenagers are still being sexually abused, beaten, and sometimes put to death by their adult custodians. Young people are still the property of their parents (or, if the parents are not appropriately conservative, the state). They are the poorest group in our society. A minor who attempts to become self-supporting faces discrimination in jobs, housing, and every other area of her or his life. Minors have no control over their educations, their places of residence, or their religious beliefs. They are routinely denied the full protection of the Bill of Rights and thus are subject to searches, curfews, and other indignities that would be illegal if applied to any other group. The laws that make it illegal for minors to work in the sex industry or have adult lovers also make it unlikely that a young woman or man will be able to escape from an abusive family. So, under the guise of protecting children, the great kiddy-porn panic has intensified their oppression.

These laws are being used against segments of our society which are far more vulnerable than the porn business. For instance, artists often do not have the resources or the experience to successfully defend themselves against vice charges, and they may have suspect politics or unconventional lifestyles, making them ideal targets for censorship and harassment. Photographer Jacqueline Livingston’s 1980 Village Voice interview was illustrated with erotic photographs she had taken of her son, Sam. These illustrations prompted the American Society for the Prevention of Cruelty to Children to insist on a meeting with staff members of the Voice to discuss “kiddy porn” in their newspaper. Livingston was accused of child abuse, investigated by the Tompkins County Department of Social Services, and only narrowly missed losing custody of her son.”
